Event Overview

The presentation examines the reception of international human rights law in German migration legislation and jurisprudence between 1993 and 2023. It draws on a data set, compiled in an interdisciplinary research project, combining quantitative and qualitative empirical as well as legal-doctrinal analyses of explanatory memoranda, case law, and legal opinions. The presentation highlights various manifestations and functions that human rights arguments can take on. It also identifies the Conventions (such as the European Convention on Human Rights) mostly referred to and explains why this is the case. Furthermore, it shows how key norm entrepreneurs (such as NGOs) promote human rights arguments in legislation and jurisprudence through their legal interventions.
